Experience Terms
Experience Hosts Continuing Responsibilities
As the Host of an Experience listing, you are responsible for understanding and complying with all laws, rules, regulations and industry licensures that may apply to your Experience. You acknowledge that you are responsible for obtaining licenses, permits, or registrations prior to providing your Experience and ensuring that such information shall be provided to Riders-Share and kept updated in a timely manner.
Equipment
Hosts shall be responsible for providing or clearly requiring all necessary equipment in the corresponding Experience listing. Hosts shall ensure that all conditions and equipment contained in their listing shall be provided including motorcycles, meals, accommodations, services, etc. that appear in your Listing OR are implied or necessary to host your Experience. Hosts shall ensure that all equipment, services, accommodations incidental to the Experience shall be in safe and in good working order, and/or in conformance to all state, local and municipal laws. Host bears the risk of loss in provision of an Experience.
Termination
Hosts of Riders-Share Experiences may terminate, or request removal of a Listing by sending an email to the Riders-Share Platform. Riders-Share reserves the right to Terminate or Suspend a Listing, User Account, or your continued access to the Experience feature, or the Riders-Share Platform, if a Host or User materially breaches this agreement and/or our other Terms or Policies, if you violate applicable laws, or Riders-Share, at their sole discretion believes such action is necessary to prevent misuse or the platform, or noncompliance with applicable laws.
Severability
If any provision in these terms is held to be invalid, void, or unenforceable, such provision will be struck and not affect the validity of and enforceability of the remaining provisions.
Experience Hosting Standard and Requirement Policy
In addition to behaving in accordance with these Experience Terms and the general Riders Share Terms, all Riders-Share Experience Hosts must meet certain standards and requirements as they may be set forth by Riders Share. Riders Share reserves the right to screen all proposed Experience listings to ensure that they demonstrate compliance with state and local laws, as well as accepted best practices in the manner of activity proposed in the Experience listing.
Publication of Experience Listings
Riders-Share may reject submitted listings if they do not meet the following criteria, or if a published listing fails to uphold these standards, the Listing may be removed. Riders-Share may ask an Experience Host to provide additional documentation and certifications that may be necessary, based on the activity or Experience to be offered.
This Policy may be updated as required, in some instances, your Experience listing may require internal independent review by the Riders Share Experience Review Department based on the nature of the Experience offered.
Listing page requirements
The Experience itinerary must be clear and accurate. The listing must allow Renters to know what to expect when booking the Experience. Your listing must contain at minimum the following level of detail:
- An itinerary that guests will be doing complete with time and date of proposed Experience
- Instructions for the meeting location for the Experience including an address and an explanation of what Renters can expect when they arrive.
- Any equipment or meals not provided by the Host which the Renters must bring.
- An explanation of the price, and a comprehensive overview of the Experience.
- In the event that an Experience requires specialized licensures or a requisite skill level to participate the Experience listing must provide such details.
Prohibited and Specialized Activities
Riders Share as a general rule does not allow certain types of activities on the platform. The Riders Share Experience Review Department will not accept listings that include the following activities as no licensure or certifications can verify the safety of such activities. This includes, but is not limited to:
· bungee jumping
· skydiving
· cave diving
· free diving
· kiteboarding
· shark diving
· ice climbing
· free climbing
· base jumping
As a general rule, Riders Share does not allow Experience activities that include known dangerous activities involving heights or water activities with inherent risks and potential for injury.
Riders Share does not allow the posting of sexually explicit content on the platform.
Experiences to the extent they may include nudity or sexually suggestive themes must have a minimum age limit of 18+. Hosts must disclose in the Experience itinerary if such activities are contemplated. We reserve the right to disallow such listings to the extent they are prurient in nature, they are intended to take place in a public place, or they do not contain an explanation of why such activity is necessary to the Experience, including behavioral Guidelines, including opt-out provisions for Renters who may be uncomfortable with the nature of the activity.
Experiences that include the use of firearms, or allow the use of projectile weapons may only be allowed at our discretion when the Host has a valid license and insurance necessary for the activity. Experiences involving firearms must have a minimum guest age limit of 18+.
Political activities
Riders Share does not allow Experiences that include direct political actions, like campaigning and fundraising, or activities that violate local laws. Informational and Educational Activities are allowed.
Host Responsibilities
Hosts must provide proof of necessary certifications or licensures based on the nature of the activity contemplated by the Experience. Additionally, the Host must provide proof of the necessary insurances for the advertised activities. Riders Share reserves the right to decline Experience listings that do not provide sufficient proof of insurance.
ID Verification
Any Experience requiring proof of a license, certification, or insurance, it will not be published if any of the following is true:
- The Host does not submit the requested documents
- The required documents are expired
- The name on the documents does not match the Host's listed name
- The documents don’t provide sufficient proof that they meet our license or insurance requirements
- Our license verification software cannot process the provided documents for any other reason (ex: blurry photo or unrecognized document type).
Host's Legal Obligations
Experience Hosts are responsible for understanding and complying with all applicable laws, rules, regulations, and other requirements that apply to their Experience, and the nature of the activities. To the extent that state or local law may require licensure or certification pursuant to health and safety regulations, or local Travel and Tourism laws within the jurisdiction the Experience is to take place, Riders Share requires that Experience Hosts demonstrate their knowledge of such regulatory requirements, and sufficient proof of an Experience Hosts compliance. Riders Share cannot undertake to be aware of all applicable State and Local laws, but we reserve the right to review all Listing applications for demonstrated compliance, and we may decline a Listing where we feel sufficient proof has not been provided.
In some jurisdictions, Experience Hosts may be required to register their Experiences as a business with the appropriate government agency at the local, state or federal level. Failure to obtain necessary registrations may result in fines, penalties. To the extent we are made aware of such requirements Experiences and their Listings may be suspended until proper registration is completed.
Participant Disclaimers
Participation in Listed Experiences requires you to review the Listing thoroughly and to ensure that you meet all listed requirements, and no impairment would prevent you from safely engaging in the listed activity. You assume all inherent risks made clear in the listing or during the course of the Experience.
Please note that Riders Share does not control the conduct of Experience Hosts and disclaims all liability. Failure of Hosts to satisfy their responsibilities may result in suspension of activity or removal from the Riders Share platform.
